Terms and Conditions

1.    These are the sole conditions upon which Wizard Pro-Gear Ltd is prepared to accept orders and supply good to the buyer.

2.    A carriage will be incurred on all orders that are delivered.

3.    Risk shall pass on delivery of goods to the buyer.

3.1  Notwithstanding (3) all goods remain the property of Wizard Pro-Gear Ltd until they are paid for in full.Until such time as the title in our goods has passed to the buyer.

3.2  We shall have absolute authority to retake, or sell, or otherwise, dispose of all or any of our goods.  

3.3  For the purpose specified in (3.2) we, or any of our agents, shall be entitled at any time and without notice, to enter upon any premesis in which our goods are installed, stored, or kept or reasonably believed to be.

3.4  We shall be entitled to seek a court injunction to prevent the buyer from selling, or transferring or otherwise disposing of our goods.

4.    Delivery dates that are supplied verbally or by writing are only estimated. Wizard Pro-Gear Ltd will not accept responsibility or be liable for any loss or damage occasioned by delay, however so caused.

5.    Any discrepancies in the delivery must be notified in 48 hours of delivery to Wizard Pro-Gear Ltd in writing. Any such claim will be subject to verification and agreement by Wizard Pro-Gear Ltd.

6.    The buyer must make payments in strict accordance with the following:

6.1  The Maximum time allowed for full settlement of invoice is 30 days after delivery of goods. (Credit account holders only, non credit account holder will pay Proforma Invoice)

6.2  Payments received late will be classed as overdue.

6.3  Overdue accounts will entitle Wizard Pro-Gear Ltd to withold delivery of all further orders.

6.4  Interest on overdue invoices shall accure from the date when payment becomes due, calculated on a daily basis until the date of payment at the rate of 8% per annum above the Barclays Bank base rate from time to time in force. Such interest shall accure after as well as before any judgement.

6.5  Any claims made by Wizard Pro-Gear Ltd against the buyers will be pursed in full to which the buyer will be liable for all legal costs incurred.

7.    All quotations and orders accepted are made on the basis of laws, taxes, labour conditions and material costs prevailing at the time of contract.

7.1  All orders are accepted at prices subject to amendment to take in account of any increases or decreases in labour, materials and fuel ocuuring before delivery date.

7.2  Prices unless otherwise stated exclude Vat.

8.   Wizard Pro-Gear Ltd under take that goods will, in all material respects, comply with any general description which we may have submitted to you, will be of satisfactory quality and reasonably fit for the purpose for which thet were manufactured subject to normal usage. Unless specifically stated otherwise, all garments are for lesiure and not sports use.

8.1  All goods are covered by a 28-day manufactures guarantee.

8.2   The buyer must make any complaint in writing in relation to goods within seven days of acceptance of delivery.

8.3   Wizard Pro-Gear Ltd has no return policy, all goods will be repaired or replaced, subject to (8.1) where after the guarantee period no responsibility will be accepted.

8.4   Goods, which have been damaged, worn, re-labelled, altered, printed upon, embroidered or otherwise processed by the buyer cannot be repaired or replaced.

9.   The contract shall be constructed and governed by laws of England and by jursdiction of the courts of England. The above clauses shall operate separately and apart.

10. Acceptance of delivery of goods shall be deemed to be conclusive evidence of the buyers acceptance of these conditions.
